Welcome to MFTFinder.com. These Terms of Service ("Terms," "Agreement") govern your access to and use of the website located at www.mftfinder.com and all related services operated by MFTFinder ("MFTFinder," "we," "us," or "our"). Please read these Terms carefully before using our Service.
By accessing or using MFTFinder, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Service.
MFTFinder is a directory service only. We are not a healthcare provider, mental health service, or crisis intervention service. If you are experiencing a mental health emergency, please call 988 (Suicide & Crisis Lifeline) or 911, or go to your nearest emergency room.
1. Acceptance of Terms
By accessing or using MFTFinder in any manner, including visiting or browsing our website, creating an account, submitting a therapist listing, or using any feature of the Service, you affirm that you are at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater), that you have read and understood these Terms, and that you agree to be legally bound by them.
If you are accessing the Service on behalf of an organization or entity, you represent that you have the authority to bind that organization to these Terms, and "you" refers to both you and that organization.
These Terms incorporate our Privacy Policy by reference. Your use of the Service is also governed by our Privacy Policy.
2. Description of Service
MFTFinder provides an online directory that enables individuals seeking therapy ("Clients") to search for and locate licensed Marriage and Family Therapists ("Therapists") based on location, specialty, insurance, and other criteria. MFTFinder also allows licensed Therapists to create and manage professional directory listings.
MFTFinder's role is limited to:
- Publishing and maintaining a searchable directory of therapist profiles.
- Providing search and filtering tools to help Clients find Therapists.
- Offering directory listing management tools for Therapists.
- Publishing educational content about mental health and therapy topics.
MFTFinder does not:
- Provide therapy, counseling, or any form of mental health treatment.
- Employ, supervise, or control any Therapist listed in our directory.
- Guarantee or warrant the quality, safety, or outcome of any therapist-client relationship.
- Verify the accuracy of every piece of information provided by Therapists in their listings.
- Facilitate, mediate, or become a party to any therapeutic relationship between a Therapist and a Client.
3. User Accounts
Certain features of the Service, including creating and managing a therapist listing, may require you to create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and promptly update your account information to keep it accurate, current, and complete.
- Maintain the security and confidentiality of your login credentials.
- Notify us immediately of any unauthorized use of your account at legal@mftfinder.com.
- Accept responsibility for all activities that occur under your account.
MFTFinder reserves the right to suspend or terminate accounts that contain inaccurate information, violate these Terms, or are used in a manner inconsistent with the intended purpose of the Service. You may not create more than one account, transfer your account to another person, or use another person's account without permission.
4. For Clients: Terms of Use
If you are using MFTFinder to search for or contact a Therapist, you agree to the following:
Age Requirement
You must be at least 18 years old to use MFTFinder independently. If you are under 18, you may use the Service only with the express consent and involvement of a parent or legal guardian, who must agree to these Terms on your behalf.
Search and Contact Features
MFTFinder's search and contact features are provided to help you identify potentially suitable Therapists. You are solely responsible for your decision to contact or engage any Therapist. MFTFinder makes no endorsement, recommendation, or guarantee with respect to any Therapist listed in our directory.
Verification Responsibility
While MFTFinder makes reasonable efforts to list only licensed therapists, you are encouraged to independently verify a Therapist's credentials, license status, and fitness for your particular needs before entering into a therapeutic relationship. You can verify therapist licensure through your state's licensing board.
No Emergency Services
MFTFinder is not an emergency service. Do not use MFTFinder in emergencies or crisis situations. If you or someone you know is in immediate danger, call 911. For mental health crises, contact the 988 Suicide and Crisis Lifeline by calling or texting 988.
5. For Therapists: Directory Listing Terms
If you are a licensed therapist creating or maintaining a listing on MFTFinder, you agree to the following additional terms:
Licensure Requirement
You must hold a valid, current, and unrestricted license to practice as a Marriage and Family Therapist (or equivalent licensed mental health professional) in the state(s) where you offer services. Submitting a listing implies certification that you meet all applicable licensure requirements. MFTFinder reserves the right to remove listings of any Therapist whose license is lapsed, suspended, or revoked.
Accuracy of Information
You are solely responsible for the accuracy, completeness, and currency of all information in your listing, including but not limited to:
- Your license number, license type, and state of licensure.
- Your practice address, phone number, and contact information.
- Specialty areas and therapeutic approaches.
- Insurance panels and accepted payment methods.
- Telehealth availability and current client-accepting status.
- Session fees and sliding scale availability.
You agree to update your listing promptly when any of this information changes. MFTFinder is not liable for any consequence arising from inaccurate or outdated information in your listing.
Professional Conduct
By listing on MFTFinder, you agree to conduct all client interactions in accordance with applicable professional ethical codes, including those of the American Association for Marriage and Family Therapy (AAMFT), your state licensing board, and any other applicable professional standards.
License Verification Cooperation
You consent to MFTFinder verifying your license status through state licensing boards, the AAMFT therapist locator, or other publicly available sources at any time. If license verification fails, MFTFinder may remove or suspend your listing until the matter is resolved.
Profile Content Standards
Your profile content must be professional, truthful, and free of misleading claims. You may not include testimonials from current or former clients in your profile (in accordance with most state ethics codes). You may not claim specialties, certifications, or training you do not hold.
HIPAA Disclaimer
The therapist-client relationship you form through contacts initiated via MFTFinder is entirely your own professional relationship, governed by your applicable legal and ethical obligations including HIPAA. MFTFinder is not a business associate under HIPAA, and information exchanged through MFTFinder's platform (such as contact form submissions) does not constitute protected health information (PHI) under HIPAA. You are responsible for ensuring your own HIPAA compliance in all client communications and records management.
6. Content and Intellectual Property
MFTFinder Content
The MFTFinder website, including its design, layout, text, graphics, software, and other content created by MFTFinder ("MFTFinder Content"), is owned by MFTFinder and protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit MFTFinder Content without our prior written consent.
User-Submitted Content
By submitting content to MFTFinder — including therapist profile information, photos, and descriptive text ("User Content") — you grant MFTFinder a worldwide, non-exclusive, royalty-free, sublicensable, perpetual license to use, store, display, reproduce, modify (for formatting purposes), and distribute such User Content in connection with operating and promoting the Service.
You represent and warrant that: (a) you own or have the necessary rights to submit User Content; (b) your User Content does not infringe any third-party intellectual property rights; and (c) your User Content complies with these Terms and all applicable laws.
Feedback
If you provide suggestions, ideas, or feedback about the Service ("Feedback"), you grant MFTFinder a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate such Feedback into our products and services without compensation or attribution to you.
7. Prohibited Uses
You agree not to use MFTFinder for any of the following purposes:
- Submitting false information: Creating listings with fabricated credentials, false names, or misrepresented licensure status.
- Impersonation: Impersonating another person, therapist, or entity, or misrepresenting your affiliation with any person or organization.
- Harassment: Harassing, threatening, or intimidating any Therapist, Client, or MFTFinder staff member through the Service.
- Scraping and automated access: Using bots, crawlers, scrapers, or other automated means to access, collect, or download data from MFTFinder without our express written consent.
- Spam: Using the Service to send unsolicited bulk communications, spam, or phishing attempts.
- Interference: Attempting to interfere with, disrupt, or damage the operation of MFTFinder or any servers or networks connected to the Service.
- Unlawful purposes: Using the Service for any purpose that violates federal, state, or local laws or regulations.
- Data aggregation for competitors: Collecting therapist profile data for use in a competing directory service or for commercial data resale without permission.
- Circumventing security: Attempting to gain unauthorized access to any portion of the Service, other accounts, or computer systems connected to the Service.
- Fraudulent reviews: Posting fake, misleading, or incentivized reviews of therapists.
MFTFinder reserves the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this provision, including removing content, suspending or terminating accounts, and reporting violations to law enforcement authorities.
8. Disclaimer and Limitation of Liability
Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, MFTFINDER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
MFTFinder does not warrant that: (a) the Service will be uninterrupted, secure, or error-free; (b) any information in our directory is accurate, complete, or current; (c) any therapist listed on MFTFinder is suitable for your particular needs; or (d) results obtained through use of the Service will be accurate, reliable, or satisfactory.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MFTFINDER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, PERSONAL INJURY, OR EMOTIONAL DISTRESS — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF MFTFINDER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In no event shall MFTFinder's total cumulative liability to you for all claims arising out of or relating to these Terms or your use of the Service exceed the greater of (a) the amount you paid MFTFinder in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100.00).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you in their entirety.
9. Not a Healthcare Provider
MFTFinder is not a healthcare provider and does not provide medical, mental health, psychiatric, or therapeutic services of any kind. MFTFinder is solely a directory platform that facilitates discovery of licensed therapists.
Nothing on MFTFinder constitutes medical or mental health advice, diagnosis, or treatment. The content published on our website, including resources, articles, and educational materials, is provided for informational purposes only and should not be relied upon as a substitute for professional medical or mental health advice.
Any therapeutic relationship formed between a Client and a Therapist discovered through MFTFinder is a direct professional relationship between those parties. MFTFinder is not a party to that relationship and assumes no responsibility or liability for the conduct of any Therapist or any outcome of any therapeutic relationship formed through our Service.
The therapist-client relationship, once formed, is governed by the applicable professional, legal, and ethical standards of the Therapist's state licensure — not by MFTFinder. HIPAA requirements, mandated reporting obligations, confidentiality duties, and all other legal obligations of the therapeutic relationship are the sole responsibility of the Therapist and, where applicable, the Client.
10. Third-Party Links
The Service may contain links to third-party websites, including therapist practice websites, professional associations, and mental health resources. These links are provided for your convenience only. MFTFinder does not control, endorse, or assume responsibility for the content, privacy practices, or availability of any third-party websites. Your access to and use of third-party websites is governed entirely by the terms and policies of those sites.
MFTFinder may display advertisements from third-party advertisers. The display of such advertisements does not constitute an endorsement of the advertised products or services. MFTFinder is not responsible for any claims made by advertisers or any transactions you enter into based on such advertisements.
11. Termination
MFTFinder reserves the right, in its sole discretion, to suspend or terminate your access to the Service — with or without notice — for any reason, including if we reasonably believe that you have violated these Terms, engaged in fraudulent activity, or if we are required to do so by law.
You may terminate your account at any time by contacting us at legal@mftfinder.com or by using the account deletion option in your account settings. Upon termination, your right to use the Service ceases immediately.
The following sections of these Terms survive termination: Section 6 (Content and Intellectual Property), Section 8 (Disclaimer and Limitation of Liability), Section 9 (Not a Healthcare Provider), Section 12 (Governing Law), Section 13 (Dispute Resolution), and any other provisions that by their nature should survive termination.
12. Governing Law
These Terms and your use of the Service are governed by and construed in accordance with the laws of the United States and the state in which MFTFinder is incorporated, without regard to conflict of law principles. You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in the applicable jurisdiction, and you consent to personal jurisdiction in such courts.
If you are accessing the Service from outside the United States, you acknowledge that you are doing so voluntarily and that you are responsible for compliance with local laws and regulations applicable to your use of the Service.
13. Dispute Resolution
Informal Resolution
Before filing any formal legal claim, you agree to contact MFTFinder at legal@mftfinder.com and attempt to resolve the dispute informally. MFTFinder will attempt to resolve the dispute within 30 days of receiving your written notice. If the dispute is not resolved within 30 days, either party may pursue formal resolution as described below.
Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service that cannot be resolved informally shall be resolved through binding arbitration administered by a recognized arbitration provider under its applicable rules. The arbitration shall be conducted on an individual basis; class action arbitrations are not permitted.
You may opt out of this arbitration agreement by sending written notice to legal@mftfinder.com within 30 days of first accepting these Terms. Opting out of arbitration does not affect any other provision of these Terms.
Exceptions
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights or to address emergency situations requiring immediate relief.
14. Changes to Terms
MFTFinder reserves the right to modify these Terms at any time. We will provide notice of material changes by:
- Updating the "Last updated" date at the top of this page.
- Posting a notice on our website or sending an email notification to registered account holders.
Your continued use of the Service after the effective date of any modified Terms constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must discontinue your use of the Service.
